You use a tilde when a one-syllable word can be confused with another that is and sounds the same way. Example: de and dé, mas and más, te and té. This is what I think.

Anécdotas Graciosas
Podría escribir un libro acerca de este tema.(tema is masculine) En una ocasión cuando era niño entré a un baño de mujeres que no estaba señalizado. Adentro había una mujer. Cuando me vio, ella empezó a gritar y yo le decía : "Lo siento". Salí corriendo pero resulta que ella estaba en el baño de hombres y yo tenía razón.

I think it is without tilde because it is one syllable and you can't confuse it with anything else. - polenta1, Apr 8, 2017
