Ley concursal

Ley concursal

Greetings,

My co-worker and I are trying to solve the following riddle: we have a legal text about insolvency that cites this act: "Ley 22/2003, de 9 de julio, Concursal" (link). The word I'm interested in is concursal.

Concursar (SD dict): to declare insolvent; declare bankrupt

Concurso (DRAE): ~ de acreedores. 1. m. Der. Juicio universal para aplicar los haberes de un deudor no comerciante al pago de sus acreedores.

Concursal: can't find it anywhere, for the time being I take it to be the adjective form of concurso. Thoughts? Other (legal) definitions of some/all of these words?

http://es.wikipedia.org/wiki/Ley_Concursal

La ley concursal es la denominación utilizada para designar al conjunto de normas sustantivas y procesales que regulan el procedimiento concursal de toda clase de deudores (personas físicas o jurídicas).

http://es.wikipedia.org/wiki/Procedimiento_concursal

El procedimiento concursal, bajo la supervisión del Juez y el nombramiento de una Administración concursal, busca lograr la solución integral para las obligaciones pendientes de pago de un deudor, ya sea mediante un convenio o mediante la liquidación forzada de sus activos, cuando se carece de liquidez o dinerario suficiente para afrontar tales obligaciones en un momento dado, aunque se tenga patrimonio que pueda ser realizado.

Thanks, Bosque, I was so busy looking stuff up in dictionaries that it didn't occur to me to check wiki for the whole phrase. Very helpful! :) - Manity, Mar 25, 2015

It looks to me from sites I've seen, including Google Translate that "concursal" simply means "bankruptcy." As a legal term, it may not fit easily into our known body of the language/vocabulary (at least not mine). I'll point out that the SD transaltor did not find the word "concursal," but rather suggested the words concurso and concursar.

Yeah, exactly. It bugs me that this word seems to be used a lot (in its niche) and yet I can't find it in a dictionary like a normal word. Thanks for weighing in, I agree with what you say. - Manity, Mar 25, 2015
