Ok, now I am looking for a translation of cuando no sea posible la suspension condicional de la ejecucion de la pena, which I believe may mean: when probation would not be a possibility.

The whole sentence reads: Por hoy, se puede detener a alguien cuando la pena prevista (para el supuesto delito) incluya prision, y cuando no sea posible la suspension condicional de la ejecucion de la pena.

I'd bet that in this context "prevista" doesn't mean "previous" but "forseen" or "anticipated", in the sense of "the penalty anticipated for the alleged crime", that is, anticipated by the law, the penalty stipulated by the law.

As of today, one can detain someone when the previous penalty (for the supposed offense) includes prison, and when conditional suspension of the execution of the penalty is not possible.
