So, in the sentence,

"Ella no permite que yo fume en la clase."

the subjunctive is used after a negative "permitir".

I am wondering if it is positive, would the subjunctive still be used, or would it's use simply change the meaning of the sentence, and it could go either way depending on what the speaker is trying to convey? For example:

"Ella permite que yo fumo en la clase."

versus

"Ella permite que yo fume en la clase."

What would the subtle differences be in the translation of those two examples? Or does it have to be one or the other?

I would say if you use "que", you should use the subjunctive, but if you don't, you shouldn't.

I would say "yes" the subjunctive is required based on this information:

....the most common way for the subjunctive to be used is .... when the indicative verb is used to state a command, permission or a desire. Thus statements such as quiero que salga (I want him to leave), mando que salga (I am ordering him to leave), permito que salga (I am permitting him to leave), autorizo que salga (I am authorizing him to leave) and consintio que salga (I am giving consent for him to leave) all use the subjunctive mood.

I think the subjunctive is the correct way to say this because of the noun clause "que yo fume en la clase" You could also say Ella me permite fumar en la clase.
