Feedback-advertisement encroaching up into menu area

Question

This is a feedback item. The new ad for the iPhone app has a picture of a phone on it, and it seems "strategically" placed so it's almost covering part of the upper menu bar area. Can there be a website policy that ads will not go above that blue line into the menu area, but rather stay down in their own adbox? This one in particular opens up iTunes if you click on it. I have accidentally clicked on it a few times tonight.
